Terms of Service
1. Agreement to these terms
These Terms of Service govern your use of Aksharamaala and other apps published by Pragya Apps LLC ("Pragya Apps," "we," "us," or "our"). By creating an account or using our apps, you agree to these terms. If you do not agree, please do not use the app.
2. Who may use our apps
Aksharamaala is designed for learners of all ages. All users under 18 require a parent or guardian to confirm consent during first-run setup before the app can be used. This rule applies universally, regardless of where the device is located. For details on how the age check works and what information is collected during setup, see our Privacy Policy.
You are responsible for all activity that occurs under your account, including any use by a child using a locally-stored profile within the app.
3. Accounts
You may sign up using Google or Apple sign-in. You are responsible for keeping your account credentials secure. Notify us promptly at support@pragya.app if you believe your account has been accessed without authorization.
4. Subscriptions and billing
4.1 Free trials
Installing the app does not start a trial or require a payment method. A one-time, 14-day free trial of Pro features is available as a separate, explicit step within the subscription purchase flow through the Apple App Store or Google Play. Starting a trial means confirming a subscription and having a valid payment method on file with Apple or Google — you are not charged when the trial starts. If you do not cancel before the trial ends, you will automatically be charged for the first subscription period on day 14, and the subscription will continue to renew as described below until cancelled. You can cancel anytime during the trial through your Apple ID or Google Play account settings; if you cancel before the trial ends, you keep Pro access for the rest of the trial at no charge, then your account returns to the Free tier. Trial eligibility (typically one trial per Apple ID or Google account) is determined by Apple and Google; we may also apply our own checks to prevent abuse.
4.2 Subscription plans
You choose one language at account setup, and it cannot be changed afterward. Certain features within that language require a paid subscription; a subscription does not unlock additional languages. Subscriptions are billed through the Apple App Store or Google Play, and are subject to the billing terms, renewal, and cancellation policies of whichever platform you subscribed through.
4.3 Renewal and cancellation
Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current billing period. You can manage or cancel your subscription through your Apple ID account settings or Google Play account settings — we do not process cancellations directly.
4.4 Refunds
Refund requests are handled by Apple or Google according to their own refund policies, since payment is processed through their platforms. We do not directly process refunds. We have no current plans to accept payment through any method other than the Apple App Store or Google Play; if that changes, this section will be updated with the applicable refund terms.
5. Acceptable use
You agree not to:
- Use the app for any unlawful purpose
- Attempt to reverse-engineer, decompile, or extract source code from the app, except as permitted by law
- Interfere with or disrupt the app's functionality or servers
- Share your account in a way that violates your subscription's intended use
- Use the app, or any content within it, to teach, tutor, or instruct third parties as part of a commercial or institutional offering — see Section 6, "Content and intellectual property," below
6. Content and intellectual property
The app, including its design, text, audio, illustrations, and underlying software, is owned by Pragya Apps or its licensors and is protected by copyright and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the app for your own personal learning, or for the personal learning of a child in your care — individual and family use only.
This license does not permit commercial or institutional teaching use. You may not use the app for any commercial, institutional, or paid instructional purpose without our prior written permission. This applies whether or not you charge for that offering. If you are a teacher, tutor, or institution interested in using Aksharamaala with your students, contact us at support@pragya.app to discuss a separate license.
If you submit any content to us through the app (for example, a profile name or feedback you send us), you retain ownership of it, but you grant us a limited license to use it as needed to operate and improve the app. We do not claim ownership of a child's local profile information, which is stored only on the parent's device.
If you post a review, rating, or testimonial about the app — whether through the app itself, the Apple App Store, Google Play, or any other platform — you grant us a worldwide, royalty-free license to reproduce, quote, and display that review or testimonial, in whole or in part, in our marketing and promotional materials, in any format or medium, with or without attribution to your name or reviewer handle. You may withdraw this permission for future use by contacting us at support@pragya.app, though we may continue using materials already published before that request.
7. Indemnification
If your use of the app, your violation of these terms, or any content you submit gives rise to a third-party claim against Pragya Apps LLC or our affiliates, officers, directors, or employees, you agree to defend us against that claim, indemnify us, and hold us harmless from the resulting damages, liabilities, costs, and reasonable attorneys' fees.
8. Children's use
As described in our Privacy Policy, a child may use the app through a local profile set up within a parent or guardian's account. Parents are responsible for supervising their child's use of the app and for any decisions about appropriate use. Teens and adults may also use the app directly, learning under their own account.
9. Disclaimers
The app is provided "as is" without warranties of any kind, express or implied. We do not guarantee that the app will be uninterrupted or error-free. We also do not guarantee specific learning outcomes — a learner's results depend on factors like individual effort, parental involvement, and how often the app is used.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PRAGYA APPS LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF DATA OR PROFITS — ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING UNDER THESE TERMS WILL NOT EXCEED THE TOTAL AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENTS GIVING RISE TO THE CLAIM.
11. Termination
We may suspend or terminate your account if you violate these terms. You may stop using the app and delete your account at any time by contacting privacy@pragya.app.
12. Governing law
These Terms are governed by the laws of the Commonwealth of Massachusetts, USA, without regard to its conflict of law principles.
13. Dispute resolution
Except for claims that qualify for small-claims court, any dispute arising out of or relating to these terms or the app will be resolved through binding arbitration on an individual basis, rather than in court. You and Pragya Apps LLC each waive the right to a jury trial and to bring or participate in a class action, class arbitration, or representative action against the other. Arbitration will be administered by the American Arbitration Association under its Consumer Arbitration Rules. If the class-action waiver in this section is found unenforceable, the entire arbitration agreement in this section will not apply to that dispute, and it will instead proceed in the courts identified in Section 12 above — the waiver and the duty to arbitrate stand or fall together.
You may opt out of this arbitration agreement by sending written notice to support@pragya.app within 30 days of first agreeing to these terms. Opting out does not affect any other part of these terms.
14. General provisions
If any provision of these terms is found unenforceable, the remaining provisions will remain in full effect, except as otherwise specified in Section 13 above regarding the arbitration agreement and class-action waiver. These terms, together with our Privacy Policy, constitute the entire agreement between you and Pragya Apps regarding your use of the app, and supersede any prior agreements. You may not assign or transfer your rights under these terms without our consent; we may assign these terms in connection with a merger, acquisition, or sale of assets. Our failure to enforce any right or provision is not a waiver of that right.
15. Changes to these terms
We may update these terms from time to time. Continued use of the app after changes take effect constitutes acceptance of the updated terms. Material changes will be reflected with an updated date at the top of this page.
16. Third-party content and attribution
Some illustrations in the app use Twemoji graphics, licensed under Creative Commons Attribution 4.0 (CC-BY 4.0). Copyright the Twemoji contributors. A full attribution is also available within the app under Settings › About.
